Conditions of Licence

  • The cost of reinstating any part of the highway damaged, disturbed or removed for the purpose of the relevant structure shall be carried out by the City Council at the expense of the Applicant.
  • The Applicant shall maintain the relevant structure in a good state of repair.
  • Adequate provision shall be made by means of contrasting colours or otherwise to render the relevant structure conspicuous to highway users. 
  • Dangerous projections shall be shielded.
  • The relevant structure shall be adequately lit at all times between half an hour after sunset and half an hour before sunrise.
  • Adequate provision shall be made to prevent dust, debris, materials or articles of any description falling onto the highway, and for this purpose the relevant structure shall incorporate a substantial projecting shield wherever the work being undertaken gives rise to the need for such a shield.
  • Where a pedestrian way is provided through or under the relevant structure, the pedestrian way shall not be less than 2.4 metres high nor less than 1.1 metres wide. 
  • The top and sides shall be covered with robust and waterproof materials in such a way as to provide complete protection to users of the pedestrian way.
  • Any doors provided in the relevant structure shall be so arranged so as not cause obstruction or inconvenience to any highway users.
  • The relevant structure shall not carry out any advertising material.

Will Tacit Consent Apply?
