Application for a licence to overhang part of the public highway

A public highway can include any carriageway, footway, pedestrian area or verge that is highway maintained at public expense. The authority may grant permission for the placing of private apparatus along, over or across a public highway. 

The Building Control Section has responsibility for dealing with applications for a licence made under Section 177 of the Highways Act 1980 which specifically deals with large projections from buildings, i.e. balconies, structural canopies or general building overhangs like projecting shop signs. 

How to apply

To apply simply complete the Section 177 application form and return, along with the initial fee of £200 & all relevant information to the

Building Control Section,
Newcastle City Council,
Civic Centre,
Newcastle upon Tyne
NE1 8PB. 

Please refer to PART 4 of the application form regarding the additional legal charges that will apply upon completion of the Section 177 Licence.

Please note that in all cases planning permission if not already granted may be required.
